Foreign investment proposals

Application lodgment

Application forms (C1, R3, and D2) and statutory notices (sections 25, 26, and 26A) are available on the Foreign Investment Review Board’s website at www.firb.gov.au. The 30 day statutory examination period, where applicable, commences upon receipt of a valid statutory notice.

The residential real estate C1 and R3 application forms may be filled in online through the Foreign Investment Online Application system (FIOLA). The relevant form and section 26A statutory notice must be printed, signed and forwarded with supporting documentation for the application to be valid.

As of January 2008, the Board has moved to electronic record keeping for all foreign investment applications (including business proposals). Please note that submitting applications electronically (via email or fax) improves processing times — it is not necessary to post originals in addition to electronic lodgement.

Please include each individual element of the application submitted as separate file attachments to the email. The preferred format for attachments would be as .pdf or .doc files. Applicants are requested to avoid attaching multiple individual pages as separate picture files. The email message should also include a webpage hyperlink to the appropriate current web addresses of any other material or information relevant to the application. Separate attachments would include the following (if applicable):

  • covering explanatory letter;
  • C1/R3/D2 form;
  • statutory notice form 25/26/26A;
  • contract to purchase the property (if submitting C1 or R3 form) or development plans (if submitting D2 form); and
  • other supporting documents such as company annual reports and financial statements.

The Foreign Investment Review Board website (www.firb.gov.au) includes guidelines relating to Australia’s foreign investment policy, application forms and statutory notices, and responses to frequently asked questions.

Foreign investment policy

The Investment Review Unit is responsible for the management of foreign investment applications and providing advice on the Government’s foreign investment policy and the operation of the Foreign Acquisitions and Takeovers Act 1975. The unit also deals with foreign investment compliance issues.

Singaporean business investors (Singapore Help Desk)

This service assists Singaporean business investors with the lodgment of foreign investment applications for proposed direct investments in Australia.
